What is process serving?

Process serving is the formal delivery of legal documents to individuals, businesses or entities involved in a court action. In California, this ensures all parties receive proper notice of legal actions against them. It’s a constitutional requirement and part of due process of law.

Why is process serving important?

Process serving is important for several reasons. First, it fulfills the constitutional requirement of due process by notifying defendants of legal proceedings against them. Second, it creates a verifiable record that legal documents were delivered according to state laws and court rules. Without proper service, courts can’t proceed with most legal actions as defendants must be given the opportunity to respond and defend themselves.

In California, legal documents can be served by:

  • Registered Process Servers (preferred method)
  • Sheriff or Marshal
  • Any person who is:
  • Over 18 years of age
  • Not a party to the case
  • A U.S. citizen or permanent resident However, for certain documents and situations, a Registered Process Server is either required or highly recommended.
Do I need a process server, or can I serve documents myself?

While California law allows some documents to be served by any adult who is not a party to the case, a Registered Process Server is highly recommended for several reasons:

  • Professional servers understand complex service requirements
  • Their proof of service carries more weight in court
  • They are familiar with alternative service methods
  • They can handle difficult or evasive subjects
  • They maintain proper documentation and records
  • They can testify in court if service is challenged.  Additionally, some documents require service by a registered process server or law enforcement officer.
What types of documents do you serve?

We serve a wide range of legal documents, including:

  • Summons and Complaints
  • Subpoenas (Civil, Criminal, and Business Records)
  • Small Claims Documents
  • Family Law Documents (Divorce Papers, Custody Orders, etc.)
  • Unlawful Detainer (Eviction) Notices
  • Restraining Orders
  • Orders to Show Cause
  • Writs
  • Citations
  • Probate Documents
  • Corporate Documents
  • Government Notices

We serve throughout California with primary coverage in the Los Angeles County area. We also serve nationwide through our network of affiliates. Our servers are familiar with local jurisdictions and have relationships with building management, security personnel and other relevant parties to facilitate fast service.

How long will it take to serve my documents?

We offer several service options:

  • Standard Service: 3-5 business days
  • Rush Service: 24-48 hours
  • Same-Day Service: When requested before 10 AM
  • Emergency Service: For time-sensitive documents Actual service time may vary depending on the subject’s availability and location accuracy.
How many attempts will you make to serve my documents?

Our standard service includes four attempts at different times and days to maximize the chances of successful service. These attempts are made:

  • At different times of day (morning, afternoon, evening)
  • On different days of the week
  • Based on any known schedule information Additional attempts can be arranged for an extra fee.
What if the person refuses to accept the documents?

In California, if a person refuses to physically accept documents, our servers can complete service by:

  1. Identifying the subject and explaining the nature of the documents
  2. Leaving the documents in the person’s immediate presence
  3. Documenting the refusal and circumstances in detail This is considered valid service under California law even if the person refuses to touch or take the documents.
What if the person cannot be found?

If the subject can’t be found at the provided address, we will:

  1. Do a basic address verification
  2. Document all attempts
  3. Provide recommendations for next steps which may include:
  • Skip tracing services to locate the subject
  • Alternative service methods
  • Service by publication
  • Other legal options per your attorney’s guidance

What happens after service is completed?

  • Time and date stamps
  • Photos or documentation

  • Service attempt details This is notarized and filed with the court as proof of service.
What is substituted service?

Substituted service is an alternative method of service allowed in California when personal service cannot be made after multiple attempts. It is:

  1. Making at least 3 attempts at personal service
  2. Leaving copies with a competent person of the household (over 18) or person in charge of the usual workplace
  3. Mailing copies to the subject’s last known address
  4. Documenting all attempts and substituted service details. This requires court approval in some cases and specific documentation requirements must be met.
