What Is a Deposition Officer in California?

A deposition officer in California is a neutral, court qualified professional responsible for conducting depositions and ensuring that all of the provisions of the California Code of Civil Procedure are complied with. A deposition officer is important because it helps preserve the integrity of the sworn testimony provided during civil litigation.

To qualify as a deposition officer under California law, a person must be either:

  • A certified court reporter
  • A notary public
  • A registered professional photocopier

A deposition officer is also responsible for the following tasks:

    • Administering oaths to witnesses
    • Accurately recording the testimony given by witnesses
    • Managing the production of documents and business records
    • Preparing certified transcripts
    • Ensuring that all parties comply with the correct legal procedures

As the impartial overseer of the deposition process, a deposition officer protects the rights of all parties involved and creates an accurate record of the deposition that can be used in court proceedings.

Whether you are conducting a deposition of an expert witness, seeking to obtain business records, or conducting testimony in a complex civil lawsuit, having a qualified deposition officer trusted by California attorneys to conduct your deposition will help ensure that your deposition will pass the test of the courts.

Comprehensive Deposition Officer Services throughout California

At Get Em Process Servers, we provide comprehensive deposition officer services designed to address the unique challenges associated with California litigation. With a combination of extensive knowledge of the law and the latest technologies available, our team delivers smooth, compliant depositions every time.

Court-Qualified Deposition Officers

Each of our deposition officers are certified and permitted under California’s Code of Civil Procedure to perform the duties of a deposition officer. Our deposition officers have significant experience in conducting depositions in complex litigation matters, whether the testimony is from a simple witness to a multiple party business dispute. You can rest assured that your deposition will be handled by a professional with a thorough understanding of the law, courtroom protocol, and the highest standards of ethics.

Deposition Subpoena Preparation & Service

Correctly serving a deposition subpoena is crucial to the enforcement of the witness’ obligation to appear and produce the requested documents. We manage the entire process — from preparing the deposition subpoena to serving the deposition subpoena and providing proof of service. Because of our expertise in process serving, your deposition subpoenas are served promptly, reliably and with all relevant supporting documentation.

Oath Administration & Testimony Recording

Admissibility of testimony depends upon proper oath administration. Our deposition officers administer the oath to the witness and create a complete and accurate record of all testimony including questions, answers and any other statement made by the witness on the record. In addition, we maintain strict policies to ensure that the record created is complete, unambiguous and compliant with all applicable laws.

Business Records Production Management

When your case requires the production of business records under CCP 2020.410 through 2020.440, we work with the custodian of the records to ensure prompt compliance. Whether your case involves medical records, employment files, etc., we manage the entire process — including serving the deposition subpoena, tracking the deadline for producing the records, and verifying that the records produced are properly certified.

Transcript Preparation & Certification

Accuracy is paramount when creating a transcript of a deposition. Our deposition officers prepare certified transcripts that satisfy all California legal requirements. While we strive for speed and efficiency, we do not sacrifice accuracy. Transcripts prepared by us are delivered to clients electronically or physically, as desired. Each transcript is carefully reviewed and certified by our deposition officer prior to its delivery.

In-Person & Remote Deposition Support

Regardless of whether you want a deposition officer present in Los Angeles, San Francisco, Sacramento, or some other location within California — or would like to hold a remote deposition using a secure video platform — we have you covered. Our staff has the capabilities to manage depositions in all formats while meeting the same stringent standards as in-person depositions.

Exhibit Management & Documentation

From identifying and documenting the exhibits to preserving the chain of custody of the exhibits, we manage all of the documentation related to the deposition with great care. Our deposition officers ensure that all evidence presented in connection with the deposition are properly documented and included in the official record.

Depositions that We Handle in California

We provide deposition officer services for all of the types of depositions recognized in California law:

Oral Depositions (CCP 2025.010 et seq.)

This is the most common type of deposition where a witness is called to give live testimony in response to the attorney questioning them. We will ensure that the notice is properly issued to all parties, that the oath is properly administered to the witness and that a complete and accurate record is made.

Depositions for Production of Business Records (CCP 2020.410)

If you wish to obtain documents without requiring live testimony, we will coordinate the production of business records, verify that the records are properly certified by the custodian and coordinate with all applicable statutes.

Expert Witness Depositions

Expert depositions require careful attention to detail. Our officers have experience with expert testimony and will ensure that all technical details are accurately documented.

Video Depositions

When a visual record of the deposition is useful, we will arrange for video deposition services and still maintain the standards of audio transcription and certification.

Telephone Depositions

When travel and logistics make it difficult to attend in-person depositions, we can assist you with telephone depositions while maintaining the professionalism and accuracy of in-person depositions.

Written Depositions (Depositions by Written Questions)

For those instances where live testimony is not necessary or not practical, we will assist you with depositions by written questions, ensuring that the delivery and responses to the written questions are properly recorded.

Regardless of what area of the law you specialize in, Get Em Process Servers offers qualified deposition officer services for all areas of litigation practiced by attorneys in California:

Personal Injury Cases — Accurate testimony is particularly important in injury cases. We manage the depositions of plaintiffs, defendants, medical experts and witnesses with extreme care and accuracy.

Medical Malpractice — The complexity of medical terms and the testimony of medical experts require a high degree of skill and knowledge by the deposition officer to accurately document technical testimony.

Employment & Labor Disputes — Workplace depositions can involve highly confidential information. We maintain the utmost discretion and protect the confidentiality of all parties involved while ensuring compliance with California employment law.

Family Law Matters — Family law depositions often involve sensitive issues and emotional content. Our officers conduct family law depositions with the utmost professionalism and sensitivity toward all parties.

Business & Commercial Litigation — Complex commercial litigation with many parties requires meticulous record keeping. We will assist you with managing the complex depositions involving corporate officers, financial records and trade secrets.

Real Estate Disputes — Boundary disputes between neighbors, title issues, landlord-tenant disputes and other real estate disputes can be effectively resolved with properly conducted depositions with certified transcripts.

Insurance Defense — When defending insurers or when seeking coverage, the deposition testimony must be accurate and completely documented. We will ensure that all details are captured.

Construction Defect Cases — Deponents in construction defect cases typically include contractors, engineers, and experts. These deponents require extremely detailed documentation. Our officers will assure that this occurs.

Professional Liability — Cases involving professional liability such as attorney malpractice, accounting errors and other professional negligence require extremely accurate documentation. We consistently meet the highest standards.

Deposition Officer Service FAQ

What are the minimum qualifications for a deposition officer in California?

A deposition officer in California must be authorized to administer oaths in accordance with the California statute governing deposition officers. Therefore, the following are minimum qualifications:

  • A certified shorthand reporter
  • A notary public (for those depositions not requiring stenographic recording)
  • In limited circumstances, a registered professional photocopier

Get Em Process Servers’ deposition officers meet all of these qualifications and are also current in their certification.

How Much Does a Deposition Officer Cost in California?

The cost of a deposition officer in California varies depending upon several factors, including the type of deposition, the location of the deposition, the length of the transcript, and whether an expedited service request is made. In general, the cost of a deposition officer will include the officer’s time, transcript preparation and certification. Get Em Process Servers will provide you with a quote that clearly outlines the expected costs and we can customize the quote to fit your particular needs.

What is the Difference Between a Deposition Officer and a Court Reporter?

A court reporter is a specific type of deposition officer who is certified in shorthand reporting and creates verbatim transcripts of testimony. However, not all deposition officers are court reporters. Notaries Public may serve as deposition officers for certain types of depositions. The main difference is that court reporters are specialists in stenographic recording whereas other deposition officers may utilize different types of recording or handle records-only depositions.

How Long Will It Take to Receive My Deposition Transcript?

Standard transcript delivery times are 10-14 business days after the date of the deposition. Expedited services are available for those cases with tight deadlines. We can arrange for daily copy (24 hour delivery), expedited service (3-5 days) or regular delivery to suit your needs. Rush fees may apply for expedited services.

Can Depositions Be Conducted Remotely in California?

Yes, California law permits remote depositions via telephone or video conference. Since the COVID-19 pandemic, remote depositions have become even more common. Regardless of whether a remote deposition is held, all procedural requirements remain in effect (i.e. proper notice, oath administration by a qualified officer, etc.) Get Em Process Servers is equipped to provide full support for remote depositions utilizing secure, professional platforms.

How Far in Advance Should I Schedule a Deposition Officer?

Although we offer same-day and next-day availability for emergency situations, we suggest that you allow a minimum of 5-7 business days for scheduling whenever possible. This affords time to properly notify all parties, coordinate schedules and prepare all necessary documents. When depositions require travel to remote locations, allowing more advance notice is beneficial.

Do I Need a Deposition Officer for Every Deposition in California?

Yes. California law requires that every deposition be taken before an officer authorized to administer oaths. Whether an informal deposition or a deposition by written questions, a qualified deposition officer must be present to administer the oath, ensure compliance with California Code of Civil Procedure and certify the deposition record.Tab Title
